Tragene

Terms & Conditions

Last updated: November 2026. These terms apply to every client of Tragene.

1. Who we are and what we provide

Tragene (“we”, “us”) provides prop firm software, setup and technical support only. We are not a prop firm, broker, trading platform operator or financial institution. “Client” means the person or business that buys or licenses our software.

2. The Client is the operator

The Client alone owns and runs their firm. The Client is solely responsible for:

  • Getting any licences, registrations and approvals required in their country, and following all applicable laws.
  • Onboarding, verifying and supporting their own traders.
  • Setting challenge prices, targets and trading rules.
  • Deciding all challenge results and breaches.
  • Paying traders and managing all funds.

3. Our non-involvement

We do not trade, manage trading, set challenge pricing or rules, decide breaches, process or approve payouts, or hold or touch funds belonging to the Client or their traders. We have no relationship with the Client’s traders and no responsibility to them.

4. Restricted use

The Client must not:

  • Onboard residents of India as traders.
  • Operate in any country or region where operating a prop firm is prohibited.
  • Use the software for fraud, money laundering, misleading marketing or any unlawful purpose.

5. Indemnity

The Client agrees to protect and compensate us for any claim, loss, penalty or cost that arises from the Client’s firm, their traders, their payouts or their failure to follow the law. This includes claims from traders, payment providers and authorities.

6. Fees and payment

Fees, the payment schedule and any revenue share or buyout amount are agreed in writing by email before work begins. Payments are made through bank transfer or a recognised payment service, and we issue an invoice for each payment. Fees already paid for completed setup work are not refundable.

7. How agreements are made

Our agreements are made by email. An agreement begins when we send the terms and the Client confirms them in writing from their own email address. Both sides should keep that email thread. If anything on this website conflicts with the terms agreed by email for a specific Client, the agreed email terms apply.

8. Ending the agreement

Either side can end the agreement by giving the written notice period stated in the agreed email terms. Any exit payment or code buyout in those terms stays payable after the agreement ends. On ending, the Client must stop using any software they have not paid for.

9. Stopping work

We may pause or stop work, support or access immediately if the Client breaks these terms, does not pay on time, or uses the software in a way that could expose us to legal risk.

10. No warranty and limits on our liability

The software and services are provided “as is”. We do not promise that the software will be free of errors, always available or suitable for any particular business result. To the extent the law allows, our total liability to the Client is limited to the fees the Client paid us in the three months before the claim.

11. Not advice

Nothing on this website or in our communications is financial, investment, tax or legal advice. Trading carries risk, including the loss of capital. The Client should take their own professional advice.

12. Governing law

These terms are governed by the laws of India.
